Welcome to BigRed Collectibles (“BigRed Collectibles,” “we,” “us,” or “our”). We operate this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”), together with all policies referenced here (e.g., our Privacy Policy and Return & Refund Policy), describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your jurisdiction, and you consent to allow minor dependents to use the Services on devices you own or manage. You may be asked to provide information such as billing, payment, shipping, and contact details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have the rights necessary to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for activities under your account. You may not transfer, sell, assign, or license your account to any other person.
2. OUR PRODUCTS
We strive to depict products accurately; however, colors and appearance can vary by device and settings. We do not warrant that product appearance, quality, or condition will meet your expectations or precisely match on-screen images.
Product descriptions, pricing, and availability may change at any time without notice. We may discontinue products or limit quantities for any person or geographic region at our discretion.
3. ORDERS
By placing an order, you make an offer to purchase. BigRed Collectibles may accept or decline any order at its discretion. Your order is accepted only when we confirm acceptance and process your payment. Please review orders carefully; we may be unable to accommodate cancellations after acceptance. If we decline, modify, or cancel an order, we will attempt to notify you using the contact details you provided.
Your purchases are subject to our Return & Refund Policy (see Section 10 below). You represent and warrant that purchases are for personal or household use and not for commercial resale or export.
4. PRICES AND BILLING
Prices, promotions, and discounts may change without notice. The price in effect at the time of your order appears in your confirmation. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import charges.
Prices on our website may differ from those offered elsewhere. Promotions may have separate terms; if there’s a conflict, the promotion terms govern. You agree to provide current, complete, and accurate purchase and payment information and to promptly update your account details so we can complete transactions and contact you as needed.
You represent and warrant that you are authorized to use your selected payment method and agree to pay all amounts due, including applicable taxes, shipping, and handling.
5. SHIPPING AND DELIVERY
Delivery times are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we transfer products to the carrier.
If a shipment appears lost or damaged, retain all packaging and reach out via Contact Us within the timeframes described in our Return & Refund Policy.
6. INTELLECTUAL PROPERTY
The Services and all materials therein—including trademarks, logos, text, graphics, images, product reviews, video, audio, and the design/selection/arrangement thereof—are owned by BigRed Collectibles, its affiliates, or licensors, and are protected by applicable laws.
You may use the Services for personal, non-commercial purposes only. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works, publicly display or perform, republish, download, store, or transmit any materials without our prior written consent. All rights not expressly granted are reserved.
BigRed Collectibles names, logos, product names, designs, and slogans are trademarks of BigRed Collectibles or its affiliates/licensors. Shopify’s marks are trademarks of Shopify. Other names and marks belong to their respective owners.
6A. INTELLECTUAL PROPERTY OF THIRD PARTIES / FIRST-SALE DOCTRINE
BigRed Collectibles offers authentic, lawfully acquired collectible goods—including trading cards, comics, toys, memorabilia, and similar products—that may feature the trademarks or copyrighted imagery of their respective rights holders. All such intellectual property remains the exclusive property of its respective owner.
We are not affiliated with, endorsed by, authorized by, or sponsored by any brand owner, publisher, manufacturer, or license holder whose marks or products may appear on items offered for sale. Any mention, depiction, or reference to third-party brands or products is solely for the purpose of accurately describing the item being sold.
Sales of these items are made under the first-sale doctrine and other applicable laws permitting the resale of legitimately obtained goods. Nothing on our website or in our listings should be construed as a claim of ownership or partnership with any rights holder, nor as authorization to reproduce, distribute, or otherwise exploit their intellectual property beyond the lawful resale of physical goods.

7. OPTIONAL TOOLS
We may provide access to tools or features from third parties on an “as is” and “as available” basis without warranties or endorsements. 8. THIRD-PARTY LINKS
The Services may contain links to third-party websites or content. We do not control and are not responsible for third-party materials or sites. Accessing them is at your own risk. Review the third party’s policies before engaging in any transaction or use.
9. RELATIONSHIP WITH SHOPIFY
BigRed Collectibles is powered by Shopify, which enables us to provide the Services. Sales made in our store are between you and BigRed Collectibles, not Shopify. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of your transactions with BigRed Collectibles. You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with BigRed Collectibles.

If you submit reviews, suggestions, ideas, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose, including to operate and improve the Services.
You represent and warrant that you own or have rights to the Feedback, have disclosed any incentives, and that your Feedback complies with these Terms and applicable law. We may—but are not obligated to—monitor, edit, or remove Feedback we deem inappropriate or unlawful. You are responsible for your Feedback and its accuracy.
12. ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, and availability). We may correct such issues and update information or cancel orders if information is inaccurate at any time without prior notice.
13. PROHIBITED USES
You may use the Services only for lawful purposes. You agree not to, directly or indirectly:
(a) violate laws or regulations; (b) infringe intellectual property rights; (c) harass, defame, or harm others; (d) transmit false or misleading information; (e) upload content that violates these Terms; (f) send spam or unsolicited promotions; (g) impersonate others; (h) introduce malware or malicious code; (i) scrape or collect personal data without consent; (j) interfere with or circumvent security features; or (k) otherwise engage in conduct that restricts or inhibits others’ use of the Services or exposes BigRed Collectibles, Shopify, or users to liability. We may suspend or terminate access for violations.
14. TERMINATION
We may suspend or terminate your access to the Services at any time in our discretion, without notice. You remain liable for amounts due up to and including the termination date. Sections intended to survive termination will continue to apply.
15. DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY STATED BY BIGRED COLLECTIBLES, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.
16. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, BIGRED COLLECTIBLES AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS (AND SHOPIFY AND ITS AFFILIATES) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; LOST PROFITS, REVENUE, SAVINGS, OR DATA; REPLACEMENT COSTS; OR SIMILAR DAMAGES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM.
17. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless BigRed Collectibles, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to: (1) your breach of these Terms or referenced policies; (2) your violation of law or third-party rights; or (3) your use of the Services. We may control the defense and settlement of any indemnified claim; you will cooperate as reasonably requested.
18. SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
19. WAIVER; ENTIRE AGREEMENT
Our failure to enforce any provision is not a waiver. These Terms, together with policies posted on the site, constitute the entire agreement between you and BigRed Collectibles regarding the Services and supersede prior agreements and communications.
20. ASSIGNMENT
You may not assign, transfer, or delegate these Terms or your rights or obligations without our prior written consent. We may assign, transfer, or delegate these Terms without notice.
21. GOVERNING LAW
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. You and BigRed Collectibles consent to exclusive jurisdiction and venue in state and federal courts located in Washington for disputes arising from or relating to the Services or these Terms.

Section headings are for convenience only and do not limit or affect these Terms.
23. CHANGES TO TERMS
You can review the current version of these Terms at any time on this page. We may update these Terms by posting changes on the website. We will notify you of material changes as required by law. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
